Specialization

Personal Status Court has jurisdiction over authentication of Personal Affairs matters such as marriage and divorce as well as cases and matters besides personal status and money matters of Muslims and Non Muslim, It has territorial and spatial jurisdiction. It also supervises the performance of marriage officials and authenticates the documents issued by them. These courts are constitutes of circuits presided by single Judge. Following are the cases which are filed or brought before it.

Moslem estates

Moslem estates are the matters which aim at identifying the estates of Moslem decedents comprising properties and pecuniary rights, inventorying,partitioning and distributing same on deserving heirs in accordance with their shares as stated in the declarations of inheritance after excluding debts and the property devolving by will.

Non-Moslems estates

Non-Moslem estates are the matters which aim at identifying the estates of non-Moslems decedents comprising properties and pecuniary rights, inventorying, partitioning and distributing same on deserving heirs according to their shares as specified in the declaration of inheritance after excluding debts and the property devolving by will.

Addition and exclusion of a Moslem heir

Cases for the addition and exclusion of a Moslem heir is a litigation concerning an estate where all or one of the litigants are moslems and where the plaintiff aims at establishing that there is a litigation on a matter included in the declaration of inheritance issued by the court, either by introducing a heir whose name was not mentioned in the Declaration, when issued, or the exclusion of another person whose name appears in the declaration but is not a legal heir, or both claims.

Addition and exclusion of a non-Moslem heir

Personal Affairs Attestations

Marriage

Marriage is included within the ratifications rendered by the court as a judicial service under its jurisdiction. It is intended to draw up the marriage contract, prepare it and adopt it among Muslim Spouses whether men or women, nationals or non-nationals and among Muslim husbands and wives adherent of a revealed religion provided that they should be nationals of Dubai, living or residing in Dubai. It is also intended to accredit the authentication of nuptial contracts of national men and women drawn up and prepared by qualified Personal affairs officials licensed as such the Cabinet of H.E. the Ruler

Divorce

The Divorce is included within the ratifications performed by the court as a service under its jurisdiction, meaning: the drawing up of the divorce certificate to Muslim spouses whether men or women, or the Muslim husbands and the wives, adherent of a revealed religion, whether nationals of Dubai, living or residing in Dubai, and the accreditation of divorce certificates drawn up by the qualified Personal Affairs officials abroad. ** Divorce procedures are only performed by The Courts Department after reviewing the family and orientation department
